What Are Medicaid Waiver Programs for Seniors?

Medicaid waiver programs — formally known as Home and Community-Based Services (HCBS) waivers — allow states to waive standard Medicaid rules in order to provide long-term services and supports to seniors and people with disabilities in their own homes and communities, rather than in nursing facilities.

The concept is straightforward: nursing home care costs Medicaid approximately $8,000–$12,000 per month. Home-based care costs a fraction of that. Congress and state governments recognized that many seniors who would otherwise require nursing home placement can live safely and independently at home with the right support services — and at far lower cost to the Medicaid program. HCBS waivers were created to fund exactly this kind of community-based care.

In 2026, all 50 states plus Washington D.C. operate HCBS waiver programs under Section 1915(c) of the Social Security Act, though the specific services, income limits, and eligibility criteria vary significantly by state.

Eligibility for HCBS waiver programs is determined by two main factors: financial eligibility and functional (care needs) eligibility. Both must be met.

Financial Eligibility

Medicaid HCBS waivers are income and asset limited. Income limits in 2026 are generally set at 100–300% of the Federal Poverty Level (FPL), depending on the state. For a single person, the 2026 FPL is approximately $15,060/year.

  • Income limit: Most states allow waiver participants to have incomes up to $2,742/month (300% of SSI rate) — even if their regular Medicaid income limit is lower. Many states use income spend-down to qualify seniors whose incomes exceed the limit.

  • Spousal protections: Community spouse rules protect a portion of assets and income for the healthy spouse at home — preventing impoverishment of the non-waiver spouse.

Functional (Level of Care) Eligibility

Seniors must need a nursing facility level of care to qualify — meaning their care needs are significant enough that they would qualify for nursing home admission. This is assessed through a state evaluation that typically examines Activities of Daily Living (ADLs): bathing, dressing, eating, toileting, transferring, and continence. Most states require difficulty with 2–3 ADLs.

Waitlists: A Critical Reality in 2026

Here is the most important thing to know: HCBS waiver programs frequently have waitlists, sometimes lasting months or years. As of 2026, approximately 700,000 people nationwide are on HCBS waiver waitlists. This is why applying immediately — even if you don’t need services right now — is critical. Get on the list early. Most states allow you to remain on the waitlist and accept services when you need them, or decline services and retain your waitlist position.

Types of Medicaid Waiver Programs Available to Seniors

1915(c) HCBS Waivers

PACE (Program of All-Inclusive Care for the Elderly)

PACE is a special all-inclusive care program for nursing-facility-eligible seniors who prefer to live at home. It provides comprehensive medical, social, and long-term care services through a dedicated PACE center. It is available in 33 states and may offer more comprehensive coverage than standard waivers for those who qualify.

How to Apply for Medicaid HCBS Waiver Programs in 2026

  1. Contact your State Medicaid Agency — Each state has its own Medicaid office. You can find yours at Medicaid.gov. Ask specifically about HCBS waiver programs for seniors or Home and Community-Based Services waivers.
  2. Call your local Area Agency on Aging (AAA) — AAAs are local organizations funded by the Older Americans Act that specialize in connecting seniors with services. Find yours at Eldercare.ACL.gov or by calling 1-800-677-1116.
  3. Request a Needs Assessment — A state worker or contracted assessor will visit your home to evaluate your care needs and determine functional eligibility. This is required for all waiver programs.
